BETA FINE ART TERMS & CONDITIONS

 

BY SIGNING THESE TERMS, YOU ACKNOWLEDGE AND AGREE THAT BETA FINE ART LIMITED OPERATES SOLELY AS AN ART GALLERY AND DOES NOT ACT AS A BROKER, FINANCIAL ADVISOR, OR INVESTMENT CONSULTANT. WE DO NOT OFFER FINANCIAL, INVESTMENT, OR TAX ADVICE, AND NO INFORMATION PROVIDED BY US SHOULD BE CONSTRUED AS SUCH. WE OWE NO FIDUCIARY DUTY TO YOU BEYOND THAT OF A STANDARD ART GALLERY. ALL DECISIONS TO PURCHASE ARTWORK ARE MADE AT YOUR OWN DISCRETION AND RISK.

WHEN YOU PURCHASE ITEMS FROM BETA FINE ART LIMITED, YOUR TRANSACTION WILL BE REGULATED BY THESE TERMS AND CONDITIONS. INVESTING IN ART CARRIES CERTAIN RISKS. PRICES CAN INCREASE OR DECREASE. ART IS AN ILLIQUID ASSET AND MAY NOT BE EASY TO RESELL. PLEASE BE AWARE THAT BUSINESS PURCHASERS MAY HAVE DIFFERENT RIGHTS COMPARED TO INDIVIDUAL CONSUMERS.

1. Your Consumer Rights Remain Protected

1.1 If you are purchasing as an individual rather than on behalf of a business, these Terms are intended to supplement, not override, your consumer rights.

1.2 A summary of your legal rights is provided below. There may be specific exceptions to these rights. You have several options to resolve disputes with us. For further information, please visit the Citizens Advice website at www.citizensadvice.org.uk.


2. Your Right to Cancel Your Purchase

2.1 If you have purchased products online or via phone, you are legally entitled to cancel, subject to certain restrictions:

2.1.1 Cancellation Deadline: If you wish to cancel your purchase, you must inform us within 14 days of receiving the product (or, if it is being stored for you, within 14 days from when it was placed in storage). If your order is delivered in multiple shipments on different days, the cancellation period starts from the day after the last item is delivered.

2.1.2 When You Cannot Cancel: You are unable to cancel an order if the items (a) have been custom-made according to your specifications, or are clearly personalised, or (b) have become inseparably mixed with other items after delivery.

2.1.3 How to Inform Us: If you wish to cancel your order, contact our Customer Service Team via email at info@betafineart.com or by post at Beta Fine Art, Unit 1B, 18-20 Hillgate Place, SW12 9ER, London, England. We will then provide you with a cancellation form to complete and return to us.

2.2 If your cancellation is accepted, you must return the product to us at your own expense within 14 days.

2.2.1 You may return the item in person at our office: Unit 1B, 18-20 Hillgate Place, SW12 9ER, London, England. Please bring the original invoice.

2.2.2 You may return the item via a reputable delivery service. Keep a receipt or proof of shipment, as failure to provide proof may result in no refund being issued if the product is lost or not received.

2.2.3 Refund reductions apply if the returned product is damaged or not in acceptable condition. Refunds will be adjusted if the item is not in its original packaging or if the packaging is damaged. If the product is altered, damaged, or unsellable, we reserve the right to refuse a refund. Contact our Customer Service Team at info@betafineart.com for advice on the best method for return.

2.2.4 Refund Timeline and Method: If you cancel before dispatch, we will issue a refund within 14 days of approving your cancellation request. If you return a delivered product, our specialists will inspect its condition and inform you of the refund decision. Refunds are issued using the same payment method originally used, without additional fees.

3. Definitions and Interpretations

3.1 The following definitions apply to these Terms unless the context requires otherwise:

  • Contract: The binding agreement governing the purchase and sale of products, detailed in Section 5.
  • Conditions: The terms outlined in this document, subject to amendments as per Section 17.5.
  • Data Protection & Legislation: The applicable UK data protection and privacy laws, including the retained EU General Data Protection Regulation (EU-2016/679) (UK GDPR), the Data Protection Act 2018, and other relevant legislation.
  • Force Majeure Event: Any event beyond our reasonable control, including but not limited to power outages, internet failures, labour strikes, civil unrest, fires, natural disasters, acts of war, terrorism, or pandemics.
  • Order: Your formal request to purchase products.
  • Price: The amount payable for the ordered products.
  • Products: The goods specified in your order.
  • Profit: The difference between the price paid for the product and the resale price.
  • Rogue Salesmen: Any individual representing the company who knowingly provides false, misleading, or fraudulent sales information, or engages in unauthorized conduct that deviates from the company’s approved procedures.
  • Resale: Selling a purchased product to any third party, including Beta Fine Art Limited.
  • Resale Price: The amount received upon reselling a product.
  • Special Price: A promotional or discounted price for certain products.
  • Storage Fees: Charges applied as per Section 9.2 for storing artwork.
  • Storage Location: Irish Art Services, Unit K9 Greenogue Industrial Estate, Rathcoole, D24 PK1H Co Dublin, or another facility as we may designate in writing.
  • We/Us/Our: Beta Fine Art Limited, a company registered in England and Wales (Company No. 14829453), located at Unit 1B, 18-20 Hillgate Place, SW12 9ER, London, England.
  • You/Your: The person placing and signing the order.

3.2 Any reference to "writing" includes electronic communication via email or other means, except fax, unless otherwise agreed.

4. The Contract and How It Is Formed

4.1 A legally binding contract is created once you place an order and we accept it.

4.2 These Terms exclusively govern the Contract and override any alternative terms you may propose unless we are legally obligated to accept modifications.

4.3 Often, you will agree to a purchase verbally over the phone with one of our consultants. This verbal agreement forms an offer by you to purchase the products under these Conditions. We will then provide the order details in writing, including a copy of these Terms. You must sign and return the order form for confirmation. If we accept the order, we will confirm this via email or another agreed method.

4.4 The contract is officially binding once we accept your order and confirm this via email.

4.5 You waive any right to rely on additional terms or conditions outside of those explicitly agreed upon in these Terms.

4.6 Any quotation we provide for products is not an offer. A quotation is only valid for 20 business days from the date it is issued.

4.7 Any samples, promotional materials, product descriptions, or illustrations found in our catalogues, brochures, advertisements, or website serve only as approximations and are not legally binding.

4.8 If you place multiple orders, each accepted order constitutes a separate and distinct contract.

5. Products

5.1 The details of the products can be found on our website. While we strive to ensure that all illustrations, photos, and descriptions match the actual products, minor discrepancies may occur due to variations in print production or differences in screen colour displays. If you require further details on any product, our consultants are available to assist you.

5.2 Product Variations: The actual colour and appearance of a product may differ slightly from what is displayed on your device screen. We ensure all measurements are accurate. We reserve the right to modify product specifications when required by law or regulatory bodies, and we will inform you should such changes occur.

5.3 If you request a custom-made product with specific dimensions, it is your responsibility to ensure that the measurements provided are correct.

5.4 Failure to Provide Required Information: If we need specific details from you to complete delivery or production and you fail to provide them, we may charge additional fees to cover any resulting delays or extra handling.

5.5 The decision to purchase any product is entirely at your discretion.

5.6 We do not make any assurances or guarantees that the products will meet your particular expectations, needs, or investment goals.

5.7 We do not guarantee that the value of the products will remain stable or increase in the future. Art values fluctuate, and products may lose value after purchase.

5.8 We are not responsible for selling artwork on your behalf. Managing the resale of a product is your responsibility. While we may occasionally offer a resale service, this is not guaranteed, and any future agreements regarding resale will be arranged separately.

6. Orders

6.1 If you need to make modifications to an order, please contact us as soon as possible. We will assess whether the requested change is feasible. If it is, we will inform you about any necessary adjustments, including price changes, revised delivery timelines, or any other relevant factors, before asking for your confirmation. If the requested modification is not possible or results in unacceptable consequences, you may cancel your order under the terms specified in Section 2, provided the product has not yet been dispatched.

6.2 We reserve the right to cancel your order at any time before dispatch, for any reason. If we do so, our only obligation will be to fully refund any payments you have made.

6.3 If the product you ordered is unavailable, we may, at our discretion, provide a similar alternative and will notify you of this by email.

7. Price & Payment

7.1 The cost of the products is as stated in the order confirmation.

7.2 Our prices include a markup to account for operational and logistical costs. This allows us to continue providing quality service, sourcing exclusive artwork, and maintaining business operations. If you wish to receive further details regarding how our pricing and markups are structured, please contact us at info@betafineart.com. We are committed to transparency and will be happy to answer any queries.

7.3 Special Offers: If we provide a discounted price or promotional offer, it will be available only for the time period stated—either 48 hours from the offer date or for the duration of the promotional campaign. If a promotion requires a discount code and you fail to provide it at checkout, you will not be eligible for the special price. Orders placed during a valid promotional period will still qualify for the discount, even if we confirm your order after the promotion expires.

7.4 We reserve the right to modify product pricing before dispatch if necessary due to external cost fluctuations, and we will inform you in advance if this occurs.
7.5 The prices at which we sell our artwork are set in alignment with the Recommended Retail Price (RRP) established by our artists. In some cases, these RRPs are contractually agreed upon with the artist, meaning discounts cannot typically be offered. The RRP does not indicate or guarantee the value of the artwork on the secondary market. We strongly encourage buyers to conduct independent research to determine whether they believe a secondary market may develop. As a gallery, our role is to sell artworks at the designated RRP, and we do not engage in secondary market speculation or valuation

 

7.5 Price Breakdown:

  • 7.5.1 The price listed does not include VAT unless otherwise stated. VAT will be charged at the applicable rate upon issuing an invoice.
  • 7.5.2 Import duties, additional taxes, or charges that may apply in the delivery destination are not included in our prices and must be paid by you.
  • 7.5.3 If you require additional shipping security or specific delivery arrangements, you must inform us in advance. Any associated costs will be charged to you.

7.6 We are a gallery, and like many others, we recommend that customers either enjoy their artwork in their homes or sell independently if they choose. However, for those who prefer to sell through Beta Fine Art, we may, at our discretion, offer a direct buyback service at a fair market rate (RRP), subject to availability and demand. Beta Fine Art charges a 10% commission on the profits from any sale made through us and we aslo apply a mark up to our goods. We are not contracted to sell your artwork

7.7 Most of our sales are conducted through back-to-company transactions. We analyse gallery-to-gallery pricing to determine market value. If you wish to sell artwork at auction, you must request this in writing. Please be aware that auctions carry risks and involve additional fees that may affect your final sale price.

7.8 Payment Schedule:

  • a) For physical products, payment must be made before dispatch.
  • b) For digital content, payment must be completed before download.

7.9 If you make a payment before we confirm your order, the funds will be held in trust. If your order is not confirmed or is rejected, your payment will either be refunded or applied as a credit toward future purchases.

8. Delivery

8.1 Delivery Arrangements:

  • 8.1.1 Each order will be accompanied by a delivery note detailing your order number, product type, quantity, and handling instructions.
  • 8.1.2 If we require the return of packaging materials, this will be indicated on the delivery note, and we will arrange collection at our expense.

8.2 The products will be delivered to the address specified in your order or to an alternative location upon mutual agreement.

8.3 Delivery is considered complete once the products have been unloaded at the delivery destination.

8.4 If your products are being stored at a designated facility, delivery will be deemed complete once they have been received at the storage location. Storage arrangements may take 4-6 weeks after payment. You will be informed once the products arrive.

8.5 Any delivery dates provided are estimates. We are not liable for delays resulting from force majeure events or a failure to provide accurate delivery instructions.

8.6 If you do not accept delivery within five business days of being notified that your order is ready, the following will apply:

  • a) The delivery will be considered complete within three business days from the original notification.
  • b) We will store the products and charge you for associated storage and insurance costs.

 

9. Storage

9.1 If you require storage, we will arrange it on your behalf at your risk. The annual storage fee is £25 per print or original artwork. Larger artworks exceeding 1.5 x 1.5 meters may be subject to higher fees based on size and volume.

9.2 Storage fees are subject to VAT.

9.3 Fees may be adjusted annually.

9.4 Storage invoices must be paid within 30 days of issue. Failure to do so may result in additional fees.

9.5 If storage fees remain unpaid, we reserve the right to deliver the artwork to your last known address at our discretion.

9.6 If you request your stored artwork to be delivered, you will be responsible for any applicable import tax or VAT.

9.7   Where the Products are liable to perish or deteriorate, Our right to sell or otherwise dispose of the taking all reasonable steps to notify You of our intention to sell or otherwise dispose of all the Products before doing so.

 

9.8   We reserve the right to deliver the Products from the Storage Location to you at any time. Delivery in accordance with this Condition 9.8 shall be to the home address most recently provided by you. You may not be refunded the Storage Fees paid (if any) in respect of the period after which delivery in accordance with this Condition 9.8 has been made.

 

9.9            This Condition 9 survives termination.

 

10. Ownership and Risk

10.1 The responsibility for the products transfers to you upon completion of delivery, whether the products are sent directly to you, a different designated delivery location, or a specified storage facility.

10.2 You will officially own the products once full payment has been received and cleared.

10.3 If the products are delivered to you or a different location designated for delivery, you must:

10.3.1 Keep them stored separately from other items to ensure they remain easily identifiable as belonging to you.

10.3.2 Refrain from removing, defacing, or altering any identifying marks, labels, or packaging associated with the products.

10.3.3 Maintain them in good condition and ensure they are insured for their full value from the date of delivery. Additionally, provide us with any reasonable information we may require about them upon request.

10.4 If the products are delivered to a storage facility, you must ensure they are adequately insured for their full value from the moment they arrive at the storage location.

10.5 Our products are sold solely for personal and private use. We do not provide any guarantees that they are suitable for business, commercial, or industrial purposes, including resale. We bear no liability for any loss of profit, disruption to business, or missed business opportunities resulting from your purchase.

11. Faulty, Damaged, or Incorrect Products

11.1 We have a legal obligation to provide products that conform to the terms of the contract. Your statutory rights remain unaffected by these terms.

11.2 If you have any complaints or concerns about a product, you can reach us by emailing info@betafineart.com.

11.3 If you wish to reject a product under your legal rights, we will arrange for its collection. The product must be returned in its original packaging, and unless otherwise agreed, it must be sent using the return service we provide. We will cover the return shipping costs.

11.4 Your entitlement to a refund or replacement does not apply if we have previously informed you of a defect in the product before confirming your order.

11.5 Refunds, whether full or partial, will be processed within 14 days after we receive the returned product and confirm it as faulty or incorrect.

12. Limitation of Liability

12.1 We hold insurance coverage for claims up to £1,000,000 per claim. The limitations and exclusions in this section reflect the extent of the coverage we have arranged. You are responsible for obtaining additional insurance to cover any excess losses.

12.2 The liability restrictions in this section apply to all claims arising under or related to this contract, including but not limited to contract law, tort (including negligence), misrepresentation, and restitution.

12.3 Nothing in this contract excludes liability for:

  • 12.3.1 Death or personal injury caused by negligence.
  • 12.3.2 Fraud or fraudulent misrepresentation.
  • 12.3.3 Breach of implied terms under Section 12 of the Sale of Goods Act 1979.
  • 12.3.4 Defective products as per the Consumer Protection Act 1987.

12.4 Subject to the above, our total liability to you will not exceed £1,000,000.

12.5 We are not liable for:

  • 12.5.1 Loss of profits.
  • 12.5.2 Loss of sales or business.
  • 12.5.3 Loss of contracts or agreements.
  • 12.5.4 Missed expected savings.
  • 12.5.5 Loss or corruption of software, data, or information.
  • 12.5.6 Damage to reputation or goodwill.
  • 12.5.7 Any indirect or consequential damages.

12.6 The value of artwork can fluctuate. We accept no liability for any decrease in value of your product. Any guidance we provide regarding resale is for informational purposes only, and we strongly recommend obtaining independent expert advice before making buying or selling decisions.

12.7 We are not responsible for unauthorized sales tactics. If you believe you have been misled, you may request a full refund, subject to verification. To initiate a claim, email info@betafineart.com within 14 days of the alleged misrepresentation. Claims will be assessed based on the details you provide.

12.8 Our pricing includes a markup to cover operational and logistical costs. If you want additional information about our markup structure and profit margins, contact us at info@betafineart.com.

12.9 We do not guarantee that we offer the best recommended retail price (RRP). Similar artwork may be available elsewhere at different prices.

12.10 This section remains in effect even if the contract is terminated.


13. Cancelling the Contract

13.1 You may have a statutory right to cancel your purchase. See Section 2 for more details.

13.2 If the period for changing your mind has expired, and you wish to cancel the contract for another reason, contact us using one of the following methods:

  • a) Call us at 020 8145 6781.
  • b) Email us at info@betafineart.com.
  • c) Send a written request by mail to Unit 1B, 18-20 Hillgate Place, SW12 9ER, London, England.

13.3 We will review your cancellation request and notify you of our decision. If we approve the cancellation, the following terms apply:

13.4 You must return the products within 14 days after notifying us of your decision to cancel.

13.5 To arrange a return, email us at info@betafineart.com. Products should be returned in their original packaging using our designated return service. We will cover return costs.

13.6 We may be unable to issue a refund if the product is damaged during transit back to us.

13.7 We reserve the right to reduce the refund amount if:

  • 13.7.1 The product has been handled in a manner that would not be allowed in a store. If we issue a refund before inspecting the returned item and later find it has been misused, you will be required to reimburse us.
  • 13.7.2 The product is not returned in its original packaging.

13.8 Refunds will be processed within 14 days after receiving and inspecting the returned product. The refund will be sent using the same payment method used for the original purchase.

13.9 Deposits may be non-refundable if the request falls outside the cancellation period specified in Section 2.1.1.

14. Events Beyond Our Control (Force Majeure)

14.1 If an event beyond our reasonable control prevents us from fulfilling our contractual obligations, we will not be held liable. In such cases, we will be granted a reasonable extension of time to meet our obligations.


15. Our Right to Terminate the Contract

15.1 We reserve the right to cancel the contract and cease supplying products if:

  • a) You fail to make a required payment and do not resolve the issue within 30 days of our payment reminder.
  • b) You do not provide necessary information for us to fulfill the order.
  • c) You fail to accept delivery or collect the product within a reasonable timeframe.

15.2 If we terminate the contract for any of these reasons, we will refund any payments you made for unprovided products (excluding storage fees for past purchases). We may deduct reasonable costs incurred due to your contract breach.

16. How We Handle Your Personal Data

16.1 Any personal information we collect, store, or process will comply with applicable data protection laws.

16.2 For complete details on how we use and protect your data, as well as your rights regarding personal information, please refer to our Privacy Policy.

17. Additional Legal Terms

17.1 This contract is solely between you and us. No third party has the right to enforce any part of these terms.

17.2 We may transfer our rights and obligations under this contract to another party. If this occurs, we will inform you in writing. Your rights under these terms will remain unaffected.

17.3 You may not transfer your obligations under this contract without our written approval.

17.4 If any part of these terms is deemed unlawful or unenforceable, the remaining terms remain in effect.

17.5 We may update these terms at any time. Changes will not impact orders already placed.

18. Governing Law and Jurisdiction

18.1 These terms are governed by and interpreted under the laws of England and Wales.

18.2 Any disputes or legal claims related to these terms fall under the exclusive jurisdiction of the courts of England and Wales.
